1. Acceptance of Terms

By accessing or using UpdataMind ("the Platform"), operated by VibeTensor Private Limited (CIN: U74909TS2025PTC197692), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

UpdataMind is an AI-powered career intelligence platform that provides resume analysis, skill gap matching, career roadmap generation, GitHub profile building, LinkedIn profile optimization, and AI career coaching. The Platform uses artificial intelligence models to process and analyze career-related data. All features are fully automated with no human-driven services involved.

3. Account and Access

• You must be at least 18 years old to use the Platform
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate information when creating your account and using the Platform
• You are responsible for all activity that occurs under your account
• We reserve the right to suspend or terminate accounts that violate these terms

4. Service Tiers and Pricing

4.1 Free Tier

The free tier includes limited AI analyses, job searches, and coaching messages per month. Specific limits are displayed on the Platform and may change at our discretion with reasonable notice.

4.2 Pro Tier ($39/month or $349/year)

The Pro tier provides higher usage limits across all features: 100 AI analyses per month, 300 job searches per month, 200 AI coaching messages, 20 deep reasoning coaching sessions, PDF exports, cloud sync, priority processing, LinkedIn keyword optimization, GitHub profile generation, and multi-profile support (up to 3 profiles). Pricing may be adjusted with 30 days notice to subscribers.

4.3 Enterprise Tier

Enterprise plans include team features, SSO, admin dashboards, and custom pricing. Terms for enterprise accounts are governed by separate agreements. Minimum 10 seats.

5. Payment, Cancellation, and Refunds

• Subscriptions are billed monthly or annually as selected
• Payment processing is handled by Paddle.com as our merchant of record. All billing inquiries and payment disputes should be directed to Paddle or to us at info@vibetensor.com
• You may cancel your subscription at any time, effective at the end of the current billing period
• We offer a full, unconditional 14-day money-back guarantee on all paid subscriptions. See our Refund Policy for details
• All prices are in USD and are inclusive of applicable taxes as determined by Paddle based on your location

6. Acceptable Use

You agree NOT to:

• Use the Platform for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to circumvent rate limits or access controls
• Reverse engineer, decompile, or attempt to extract the source code of the Platform
• Use automated tools, bots, or scrapers to access the Platform
• Resell, redistribute, or sublicense access to the Platform
• Upload malicious content, malware, or exploit vulnerabilities
• Harass, abuse, or harm other users or VibeTensor personnel

7. AI-Generated Content Disclaimer

The Platform uses AI to generate career analyses, recommendations, and optimized content. While we strive for accuracy, AI-generated content is provided as guidance and should not be treated as professional career counseling, legal advice, or guaranteed outcomes.

• AI analyses are based on the data you provide and general career patterns
• Scores, match percentages, and recommendations are estimates, not guarantees
• You are responsible for reviewing and verifying all AI-generated content before use
• We do not guarantee employment outcomes, salary increases, or interview success

8. Intellectual Property

The Platform, including its design, code, AI model integrations, and branding, is the intellectual property of VibeTensor Private Limited. All rights reserved.

You retain ownership of the personal data and content you submit. By using the Platform, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing our services. This license terminates when you delete your account.

9. Limitation of Liability

To the maximum extent permitted by applicable law, including the Indian Information Technology Act, 2000 and the Consumer Protection Act, 2019, VibeTensor Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or employment opportunities, arising from your use of the Platform.

Our total aggregate liability for any claims arising from the use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Platform may experience downtime for maintenance, updates, or factors beyond our control. We are not liable for any loss resulting from service interruptions.

11. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.

Any disputes arising from these terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts in Warangal, Telangana, India.

12. Consumer Protection (E-Commerce) Rules, 2020

In compliance with the Consumer Protection (E-Commerce) Rules, 2020, we provide the following disclosures:

• Entity type: Inventory e-commerce entity (we own and operate the Platform and provide services directly)

• Cancellation and refund: 14-day unconditional refund, cancel anytime from account settings

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated through the Platform with at least 30 days notice. Continued use after changes take effect constitutes acceptance.
